A Brief Guide For Landlords
Your questions answered
Furnished or Unfurnished?
A property can be let fully furnished, part furnished or unfurnished. In all cases where the tenancy is for the limited period, it should include carpets and curtains.
Preparation of inventory/schedule of condition
These are important documents which list details of contents and their condition both at the commencement of the tenancy and on expiration, when we carry out a final inspection.
Prospective Tenants
Finding the 'right' tenant is vital. Potential tenants are required to complete an in-depth application form outlining personal details, existing employment, salary details and current housing status. References are then taken.
The Tenancy Agreement
The 'Assured Shorthold Tenancy Agreement' (under the Housing Act 1988) has a minimum fixed term of six months. There is an option to vacate or renew at the end of the term providing all parties are in agreement. Landlords can regain possession at the end of the tenancy so long as we serve two months notice on their behalf. Please be aware that tenants are entitled to exclusive use of the property during the agreed term.
Day-to-Day Outgoings
Whilst your property is let the tenant will be liable to pay Council Tax, Gas, Water, Electricity and Telephone charges. All the utility companies will be advised prior to the commencement of the tenancy and meter readings will be taken.
Buildings and Contents Insurance
It is vitally important that you advise your insurance company prior to letting your property to ensure that you are covered for third party, public liability and for defective premises. You as the landlord are responsible for both the buildings and your contents insurance i.e. to cover any items belonging to you left in the property. During the tenancy, the tenants are responsible for arranging insurance cover on their own personal belongings.
Who should be advised of the letting?
If your property is subject to a mortgage, your bank or building society will require details. If the property is leasehold, it may also be necessary to obtain consent from the freeholder.
Repairs and Maintenance
If we believe that a repair is urgent, this will be carried out automatically on your behalf. Other repairs will be undertaken up to £100.00 plus VAT - beyond this we will in the first instance require authority to proceed.
Do you have any tax liabilities?
Whilst rental income may be taxable, a number of outgoings associated with the letting of the property may be treated as allowable expenses. Any landlord resident outside the UK will need to apply to the Inland Revenue to receive rental income with no tax deducted.
Furniture and Furnishings (Fire) (Safety) Regulations 1988
All the soft furnishings must comply with the Furniture and Furnishings (Fire) (Safety) Regulations 1988. It is an offence to 'supply' furnishings that do not meet with the Fire Resistance Requirements.
Gas Appliances and Recent Regulations
There is a need for all gas appliances to be serviced annually. We can arrange for CORGI registered plumbers to do this for you.
Electrical Safety Regulations
The electrical safety regulations require that any electrical appliances supplied, included fixed electrical installation (i.e. the mains wiring), are safe and that it is the duty of the landlord to ensure that the appropriate checks and safeguards are carried out.
